פניה לכבוד היועץ המשפטי לממשלה

מר יהודה ויינשטיין הנכבד!

אני שיידין אנטולי, אזרח ישראלי, ת.ז. 310474606 נאלץ לפנות אליך כאל יועץ המשפטי לממשלה בבקשה לפתוח מיד בחקירה של פעילות עויינת כלפי מדינת ישראל וכלפי אזרחיה של מדינת ישראל מצד הנהלת ההסתדרות.

במשך מספר שנים אזרחי ישראל הופכים לקורבנות לסחטנות גסה ומעשים נפשעים שיזמה הנהלת ההסתדרות, אשר יוזמת שביתות בענפים שלמים במדינה כולל רשויות ממלכתיות חשובות ביותר במטרה יחידה: להשיג משכורות גבוהות יותר עבור השובתים שמצבים הכלכלי טוב בהרבה  ממצב רוב האוכלוסייה שבמהלך שנים רבות נמצאת מתחת לקו העוני.

למשל אני בעצמי לאחר שנפצעתי במהלך עבודתי בגיל 66 נאלצתי לעזוב את עבודתי ולהסתפק בקצבת זקנה ובקצבת השלמת הכנסה, ביחד עם קצבת זקנה של אשתי הסכום מגיע רק ל-2795 ₪ (ברוטו) אשר מתוכם אנו משלמים משכנתה בסך 1200-1400 ₪. האם זה מקובל? אך ביטוח לאומי משלם סכומים אלה לכולם במשך שנים רבות. כל שנה מבקר המדינה בדו"חות שלו מציין שיותר ממיליון וחצי אזרחים נמצאים מתחת לקו העוני. כאשר ביצעתי חקירה משלי גיליתי שביטוח לאומי גונב בצורה גסה מאזרחים ולא משלם את הקצבאות בשלמות ומפחית פי עשרה את המענק לנכים. התביעות שהוגשו נגד ביטוח לאומי נדחו בהתבסס על יישום רב שנים של גישה זו, ערכאות משפטיות גבוהות יותר דחו את הערעורים בגלל שאין סיבה לא לסמוך לבתי לערכאות משפטיות נמוכות יותר  (ראה פסק דין של בית הדין  הארצי לעבודה בתיק  עבל 142/06 ופסק דין של בית הדין  הארצי לעבודה בתיק  עבל 323/08 שיידין אנטולי נגד ביטוח לאומי).

ההסתדרות לא עוזרת לאנשים האלה מכוון שלא מקבלת שום דמי חבר מקצבאות שלהם. אך היא תומכת ברצון רב בעובדי הנמל, עובדי הפרקליטות, דיפלומטים, עובדי חברת חשמל ששכרם בממוצע מן הגבוהים במשק ומפגינה בכך את האנוכיות ואת האינטרסנטיות שלה.

כמו כן מוסדות ההסתדרות אדישים לחלוטים לגורלם של אזרחי ישראל, למעמדה שלמדינת ישראל, לפגיעה משמעותית בכלכלה עקב הפסדים כספיים, קנסות וביטולם של חוזים. הנזק שנגרם ע"י הארגון הנ"ל קשה לתאר, הוא מתבטא לא רק בפגיע כלכלית.

אני אזרח ישראל הלוקח ללב את אי יכולתה של הממשלה ושל הכנסת להפסיק את ההפקרות הזו, דורש ממך בתור היועץ המשפטי לממשלה לפעול מיד ובתקפות על מנת להעמיד לדין את הנהלת ההסתדרות ובעתיד לחייבם להרשות לשבות רק לאותם אנשים אשר הצהירו באופן אישי שהם רוצים להשתתף בשביתה ומבינים בבירור את אחריותם כלפי אותם אנשים וגופים שיפגעו כתוצאה מהשביתה.

פנייתי אליך לא מבטלת את אפשרות הגשת התביעה בבית המפשט הגבוה לצדק אם לא יינקטו מיידית אמצעים על מנת להפסיק את ההפקרות הזו.
